A man faces murder and aggravated assault charges after a shooting outside a Doraville restaurant killed a 44-year-old customer and injured two people inside early Sunday, Oct. 25.

Daniel Roman-Cortez, 44, is charged with murder and six counts of aggravated assault with a weapon in the death of Pablo Gutierrez-Gallegos, according to jail records cited by Law&Crime.

Doraville police said Roman-Cortez told investigators he believed Gutierrez-Gallegos was having an affair with his wife. That allegation has not been independently established.

Officers responding to reports of gunfire around midnight spotted Roman-Cortez attempting to leave in a blue pickup truck, according to a police account reported by Fox 5 Atlanta. They stopped the truck and took him into custody.

“I shot him, I killed him,” Roman-Cortez told officers, according to police.

Gutierrez-Gallegos was found outside the restaurant on Buford Highway. Officers attempted lifesaving measures, but DeKalb County paramedics pronounced him dead at the scene.

Two customers inside the restaurant were hurt by glass shattered during the shooting. Emergency personnel treated them at the scene and determined neither had serious injuries, police said.

Doraville police are investigating with assistance from the Georgia Bureau of Investigation. The restaurant was not named in the reports reviewed.

Law&Crime reported Oct. 26 that Roman-Cortez was being held without bond at the DeKalb County Jail and that his next court date was not listed. The charges remain allegations.

Gutierrez-Gallegos’ family has established a GoFundMe campaign with a $7,000 goal to cover funeral expenses and return his remains to Veracruz, Mexico. The page lists Carmen Torres as the organizer and his sister, Clara Gutiérrez, as the beneficiary.

In the campaign description, his sister remembered him as a friendly person whose death had devastated the family. Donations were paused when the page was reviewed.
